Before any town or community incorporates as a municipality, it must first file an application of incorporation with the Secretary of State in accordance with the S.C. Code of Laws 5-1-10 et seq. Before issuing a corporate certificate to a proposed municipality, the Secretary of State must review the application for incorporation, as well as the recommendation of the Joint Legislative Committee on Municipal Incorporations to make sure the municipality has met all statutory requirements.
